Carta do PRRI à Comissão Europeia sobre o Estado de Direito, Legislar Melhor e a legislação da UE sobre OGM

Dear President Juncker and Commissioners Timmermans and Andriukaitis,

Escrevo em nome da Research Público e Regulação Initiative (PRRI), uma organização mundial do setor público cientistas ativos em biotecnologia moderna para o bem comum. PRRI aims to a) help public researchers in better understanding regulations pertaining to modern biotechnology and b) to bring better understanding of science and research to the public debate on those regulations. The establishment of PRRI was triggered in 2004 by the apparent absence of public sector scientists in Meetings of the Parties to the Cartagena Protocol on Biosafety. Ainda, PRRI also takes great interest in the EU legislation on genetically modified organisms (OGM), among other reasons because the EU regulations and policies on GMOs can have a significant impact on regulations and policies in developing countries, and thereby on important public sector research in those countries.

It is therefore very important that the Member States and the institutions of the European Union adhere to the democratically adopted EU legislation for GMOs, such as the Directive on the Deliberate Release of GMOs. The objectives of that Directive are 1) harmonisation, e 2) protection of human health and the environment. The basis for decision making under that Directive is scientifically sound risk assessment, and a key role for that is placed in the hands of scientific bodies, such as the European Food Safety Authority (AESA).

As you may know, alguns Estados-Membros agiram repetidamente, ao longo dos anos, em violação dos objectivos e das disposições dessa directiva, por exemplo, evocando a chamada «cláusula de salvaguarda» sem fornecer novas informações científicas que justifiquem uma medida tão drástica.

Por isso, peço respeitosamente a sua confirmação de que a Comissão Europeia, como guardião da legislação e dos princípios da UE, tomará as suas decisões relativas à legislação sobre OGM em conformidade com o Estado de Direito e os princípios de Melhor Legislação, Isto é. dentro dos prazos e com base nos critérios legais previstos na lei.

Um bom exemplo para demonstrar a seriedade da Comissão relativamente ao Estado de Direito e aos princípios de Melhor Legislação seriam os dossiês de cultivo de OGM sobre os quais a Comissão terá de decidir em breve. Dado que a Comissão, com base no parecer positivo da EFSA, apresentou projetos de decisões de autorização ao comitê permanente (que resultou numa «ausência de parecer» por parte da comissão), e dado que não foram apresentadas novas informações relevantes para os objectivos da directiva, seria uma expectativa legítima que a Comissão adotasse decisões de autorização positivas em conformidade com os projetos de atos de execução que apresentou ao comité.

For public sector scientists it is extremely important that the implementation of EU rules for GMOs is based on the law, transparente, predictable and in line with the so called ‘Innovation Principle’. Over the years much important EU public research in the field of biotechnology has been stopped or moved abroad because of the way in which the GMO regulations have been implemented. This regrettable development significantly reduces the possibilities of the EU to strengthen sustainable farming, cuidados de saúde e proteção ambiental, and must therefore urgently be reversed. The European Commission is in a unique position to contribute to that.

The PRRI stands ready to elaborate on this and to assist the Commission in its task.
